These Terms of Service ("Terms") govern access to and use of Recoverly's missed-call recovery software (the "Service") by the business that signs up for an account ("Customer," "you"). By creating an account or using the Service, you agree to these Terms.
1. The Service
Recoverly monitors a phone number you provide, sends automated text messages in response to missed calls, runs an AI-driven conversation to qualify the caller's request, and books appointments to a calendar you connect. Recoverly is a tool to help you respond faster to inbound calls — it does not guarantee that any particular call will convert into a booked job, a completed job, or revenue.
To stop receiving automated text messages from Recoverly, reply STOP at any time. Reply HELP for help. Message frequency varies by conversation. Message and data rates may apply, based on your mobile carrier plan. Wireless carriers are not liable for delayed or undelivered messages.
2. Your account and responsibilities
- You must provide accurate business information and keep your account details current.
- You are responsible for the phone number(s) you connect to the Service, including having the right to forward or route calls from that number.
- You are responsible for ensuring your use of the Service — including automated text messages sent to your callers — complies with applicable law, including telemarketing and messaging laws such as the Telephone Consumer Protection Act (TCPA). Recoverly provides technical means to detect and honor opt-out requests (including the standard STOP-family keywords and common plain-language requests to stop being contacted, consistent with the FCC's "any reasonable manner" revocation rule), but you remain responsible for how you use the Service and for honoring any opt-out request our automated detection doesn't clearly recognize.
- Message frequency for automated texts sent through the Service varies by conversation. Message and data rates may apply, based on the recipient's mobile carrier plan. Phone numbers collected through the Service are not sold or shared with third parties for their own marketing purposes.
- You are responsible for reviewing and confirming appointment details, pricing communicated to customers, and any dispatch decisions — Recoverly qualifies and books leads, but you remain responsible for fulfilling the work.
3. Fees and billing
Subscription fees are billed in advance on a recurring basis through our payment processor, Stripe. Metered usage fees (such as per-booked-appointment charges) are calculated based on activity during the billing period and charged at the end of that period. Fees are described on our pricing page and may change with notice; continued use after a price change takes effect constitutes acceptance of the new pricing. See our Refund Policy for cancellation and refund terms.
4. Acceptable use
You agree not to use the Service to: send unlawful, deceptive, or harassing messages; contact individuals who have opted out or who you do not have a legitimate basis to contact; misrepresent your business or the nature of a call; or attempt to interfere with or reverse-engineer the Service.
5. Third-party services
The Service relies on third-party providers — including Twilio, Anthropic, Google, and Stripe — to function. Your use of the Service is also subject to the applicable terms of those providers where relevant (for example, connecting Google Calendar is subject to Google's terms). We are not responsible for outages or issues caused by these third-party providers, though we'll work to minimize their impact on your account.
6. Availability
We aim to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. Scheduled maintenance, third-party outages, or unforeseen issues may cause temporary downtime.
7. Disclaimer of warranties
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the AI qualification conversation will always accurately capture a caller's needs, or that any lead will result in a completed sale.
8. Limitation of liability
To the maximum extent permitted by law, Recoverly and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or business opportunity, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in the three months preceding the claim.
9. Indemnification
You agree to indemnify and hold Recoverly harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service in violation of these Terms or applicable law, including claims related to messages sent to your callers.
10. Termination
You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. We may suspend or terminate your account for violation of these Terms, non-payment, or misuse of the Service, with notice where reasonably possible.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be posted here with an updated date; continued use of the Service after changes take effect constitutes acceptance.
12. Governing law
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-law principles. [Confirm this reflects your actual business registration state before launch.]
13. Support and contact
For customer support, including help with your account or text messages, contact us through our contact page or email support@recoverlo.com. For legal questions about these Terms specifically, email support@recoverlo.com.
